The U.S. Supreme Court has ruled that President Trump's invocation of the Alien Enemies Act (AEA) exceeds the scope of the law and is therefore unlawful. The President and his administration do not have the legal authority under the AEA to detain, transfer them within the United States, or remove them from the country. The AEA applies only when “there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government.” Since the United States is not at war with Venezuela, the President’s use of the AEA in this context is unconstitutional. Furthermore, The Federalist Papers emphasize the importance of a balanced government where each branch—legislative, executive, and judicial—respects and performs its constitutional duties to protect liberty and uphold the rule of law. Federalist No. 78 highlights the independence of the judiciary and its critical role in interpreting the Constitution, asserting that Supreme Court decisions are final and must be respected (Hamilton, 1788). When a President Ignores or Refuses to Enforce Supreme Court Rulings When a President refuses to enforce or disregards these rulings, it threatens the constitutional order and the system of checks and balances established by the framers. Such actions undermine the judiciary’s authority and weaken the rule of law, which are essential to the stability of the republic. The Federalist model clearly states that the executive must comply with judicial decisions; failure to do so could justify Congressional action, including impeachment, to protect the integrity of constitutional governance.
